These "Terms & Conditions" represent a legal document (Agreement) between you, the user ("you","visitor", "purchaser", "customer", "client") and us and they are an integral part of this Website - sylvieadams.com. By browsing and using this website, you are agreeing to all these terms.

We makes every effort to ensure the accuracy of all information on this site but takes no responsibility for any errors or omissions that may occur. We reserve the right to correct any errors, inaccuracies or omissions and to change or update information on the sylvieadams.com Website at any time, without prior notice.
CONFIDENTIALITY
All the information you provide us is governed by our Privacy Policy. Please read our Privacy Policy for further information.
INTELLECTUAL PROPERTY
The site and all of its original content including texts, images, graphics, interfaces, codes, content selection and layout are the exclusive property of Sylvie Adams or the property of the respective right holders and are, as such, fully protected by the appropriate international copyright law and other laws on intellectual property rights. Reproduction, publication, redistribution, transmission or any other form of use without our prior written consent is strictly prohibited.
Upon the sale of an artwork, the artist remains the sole owner of the all the intellectual property rights, including reproductions rights, unless a separate written agreement is entered. No reproduction, publication, redistribution, transmission, and/or adaptation, and/or modification to the artwork, or any other form of use may be made without the written permission of Sylvie Adams.
PRICING
Prices listed are in Canadian dollars (CAD) and will also be charged in Canadian dollars. Applicable taxes and shipping costs are not included in the price. Applicable taxes will be calculated at checkout, once an address is entered. Shipping costs are estimated at checkout. A surcharge may apply, if shipping to rural or remote areas (Please see Shipping Info below for more details). Additional insurance (if required) and custom fees & duties for International shipments are not included in the price.
If other currencies than Canadian dollars are indicated on this site, they are approximations provided as a guide only and are not necessarily 100% accurate. The exchange rates indicated are standard bank rates but they may differ from the rate charged by the user's card issuer or financial institution.
PAYMENT
The artworks remain the property of Sylvie Adams until full payment is received of the indicated prices. All payments are due when the order is confirmed. When you confirm your order by clicking on the "Purchase" button, you declare to have read and accepted all of these terms and conditions. Upon registration of your order, an acknowledgement will be sent to you by email after validation of payment. However, we reserve the right to cancel any order from a customer with whom there is a dispute over the payment of a previous order, or if the order includes fraud, misrepresentation, or unlawful activities. If no payment is received the artwork will not be shipped.
Payments are made through certified gateway providers such as Paypal and Stripe which provide the security for your sensitive/credit card information. At no point is this information stored on this website. All sensitive/credit information you supply is encrypted via Secure Socket Layer (SSL) technology and protected with the gateway providers' industry standards.
SHIPPING INFO
Shipping costs are the responsibility of the purchaser. Shipping charges vary depending on product size, weight and destination. All purchases will be crated in custom built wood crates or packaged in cardboard shipping boxes or tubes (depending on the size of the art, the medium and the destination) and are protected to ensure safe arrival. Shipping costs are estimated at checkout once an address is entered. Shipping costs are not final until a quote is received by Sylvie Adams from a carrier. A surcharge may apply, if shipping to rural or remote areas. If this is the case, we will contact you before shipping for your consent or we will fully reimburse your purchase.
Some large artworks can be taken off their stretchers, rolled and shipped in a card box tube to reduce shipping costs. These artworks will need to be re-stretched on a new frame at their destination and this cost is the responsibility of the purchaser. Any damage to the artwork during re-stretching will be the responsibility of the purchaser. If you would like to use this method of shipping, please contact us before making a purchase.
Time for delivery will vary depending on destination. Estimations are as follows:
Canada = 1 - 2 weeks
USA = 1 - 4 weeks
Other countries = 1 - 6 weeks.
We usually ship Ground Services for Canada and the continental USA. For international shipping we use Express Services. We can only confirm time for delivery once the shipping has been ordered and validated by the shipping company. If required, it is possible to ship by another carrier and/or obtain a faster service, please contact us for costs and timeframes.
Delivery will be made to the address you have indicated during checkout on the order form. You can also contact us at any time if you have specific shipping questions.
INSURANCE & DAMAGES
Our liability ends when the order is delivered to the carrier and we are not responsible in any way for any damage or loss that may occur during shipment. The insurance included with the shipping costs is very limited ($0-$100, depending on the carrier). We strongly recommend that you take out additional insurance to cover the total value of the work. On this Website, in some instances, insurance can be selected in the artwork’s page and bought at the same time as the artwork. If this is not the case and you need insurance, please contact us.
If you have purchased additional insurance and the package suffers damage or loss during shipment, we will ensure that the situation is resolved effectively. Please note the following:
Artworks are insured for shipping to clients for their total value. It is the responsibility of the purchaser to issue specific, written and detailed reservations to the shipping company or carrier in case of suspected or visible default or damage, writting "suspected dammage / subject to verification / damaged" on the delivery note before signing in order to benefit from the insurance contracted. It is necessary to send us by email the list and photos of the damage no later than 48 hours after delivery.
CUSTOM FEES & DUTIES
Custom and duty fees are applied to international shipments at the discretion of each receiving country. These charges are beyond our control and are the responsibility of the consignee (buyer). For customers in the USA, original artworks are entitled to enter the USA duty-free under the North American Free Trade Agreement (NAFTA) or the new United States - Mexico - Canada Agreement (USMCA) which is replacing NAFTA.
CANCELLATIONS & RETURNS
You can cancel your order at anytime before the order is shipped by contacting us at info@sylvieadams.com or calling 1-514-349-3125. In the event that a custom built wood crate or cardboard box was made for shipping, you will be charged the cost of that crate or box.
In the event that you are not satisfied with your purchase, items purchased online can be exchanged for another piece of art within 48 hours of receipt. Contact us immediately at info@sylvieadams.com or call 1-514-349-3125. You will receive a credit note valid for a period of four (4) months. Artwork returned for exchange must be packaged in the same container and with the same care as it was shipped. All artwork returned for exchange must be received undamaged. Return shipping costs and insurance covering the total value of the artwork are the responsibility of the purchaser. If you are unsure if an artwork will meet your needs, do not hesitate to contact us to discuss, prior to purchase.
COMMISSIONS
Sylvie Adams is available for commissioned art. Please contact us to discuss your needs. Terms are 50% non-refundable deposit of the value of the artwork payable when commissioning the artwork and 50% when the artwork is finished and approved by the client.
CHANGES
"Sylvie Adams" may change its Terms & Conditions from time to time. Most changes are likely to be minor and at Sylvie Adams’ sole discretion. We encourages visitors to frequently check this page for any changes. Your continued use of this site after any change in these Terms & Conditions will constitute your acceptance of such change.
DISCLAIMER AND LIMITATION OF LIABILITY
Although we strive to provide up-to-date and accurate information on our website, errors or omissions may occur. As a result, we do not provide any guarantees or make any representations as to the accuracy or reliability of the information contained on this website.
This website, the content, information, services and products provided herein, including, without limitation, the texts, graphics and links, are provided on an “as-is” basis, without any guarantees, whether express or implied. To the fullest extent permitted by law, we disclaim all guarantees, express or implied, including, without limitation, implied guarantees of quality, fitness for a particular purpose, non-infringement or absence of computer viruses and guarantees arising from established business practices or course of performance. We do not make any representations or give guarantees that the functions contained on this website will be uninterrupted or error-free, that failures will be corrected or that the website or server providing access thereto are free of viruses or other harmful components. Under no circumstances shall we be held liable in the event of non-performance of the delivery of an order due to reasons beyond our control, in particular in the event of force majeure, disruption or strike of the postal or carrier services and means of transport and/or communications.
Under no circumstances shall we be held responsible for any loss, injury, damage or death incurred from items purchased by the client.
APPLICABLE LAW
This agreement is governed by the laws of the Province of Quebec, Canada. Except in the case of recourse to an injunction, the parties recognize that any dispute or controversy must be submitted, to the exclusion of any recourse in ordinary courts, to an arbitrator in accordance with the provisions of the Civil Code of Québec and of the Code of Civil Procedure (Quebec). The arbitration will be held in Montreal, province of Quebec and will be arbitrated on an individual basis.. The decision of the referee will be final and without appeal and will bind the parties. The costs of the arbitration will be paid in accordance with the decision of the arbitrator.
